Description:
This 40-hour Family Arbitration: Theory, Skills & Practice course is an intensive professional training program designed to prepare participants to competently conduct family law arbitrations and meet applicable professional designation requirements. The program combines legal theory, arbitration procedure, practical skills development, and best practices through recorded lectures, readings, tests, discussions, and mandatory live online tutorials. Key topics include arbitration law and procedure, natural justice principles, screening for power imbalances and family violence, suitability assessments, arbitration agreements, procedural planning, evidence law, hearing management, decision-making, award writing, enforceability of awards, costs awards, and post-award remedies. The course emphasizes ensuring fairness, due process, and informed decision-making throughout the family arbitration process.
A major strength of the program is its highly practical, experiential learning approach. Participants work through a comprehensive case study and engage in role plays that simulate every stage of a family arbitration, including screening, pre-arbitration conferences, examination and cross-examination of witnesses, parenting and financial arbitration scenarios, and a full mock arbitration hearing. Students also develop drafting skills by preparing arbitration-related documents and procedural materials. Instruction is provided by experienced family law arbitrators, mediators, judges, and practitioners, giving participants direct exposure to real-world arbitration techniques, strategies, and challenges. By the end of the course, learners should have the knowledge and confidence to plan, conduct, and conclude family arbitration proceedings in a professional, fair, and enforceable manner.
